Medical Amnesty Policy Individual-based Examples
1) A student returns to their residence hall after a party where they were drinking underage. When the student opens the door, the student finds a roommate passed out on the floor. The student calls 911, stays with the roommate, and cooperates with medical personnel when they arrive on scene.
Neither student will receive conduct sanctions as the three steps of the policy ( call, stay, and cooperate ) were followed and neither student had used the amnesty policy previously; however, they will still be given educational resources. If the student attempted to take the roommate to the hospital, neither would have been given amnesty as the call and stay requirements of the policy would not have been met. Additionally, had the unconscious student used the policy previously, only the caller would have received amnesty.
2) Two students, who are both underage, choose to attend a house-party with some friends. A few hours later, one of the students drinks too much and becomes unconscious. The unconscious student has not had to use the amnesty policy before. Another student who has also been drinking calls 9-1-1, stays with the unconscious student, and cooperates with medical personnel when they arrive on scene. This student has not had to make a call related to the policy before.
Both students will receive amnesty as they have not had to use the policy previously; however, they will still be given educational resources. Had the caller not followed all three steps of the policy ( call, stay, and cooperate ) then neither student would have been eligible for amnesty. In addition, even if the caller had used the policy before, the caller would have still received amnesty so long as the three step policy was followed.
3) Two students decide to consume marijuana laced brownies at their off-campus apartment. After sampling a few brownies, one of the students overdoses and passes out. The unconscious student has not used the amnesty policy previously. The other student calls 9-1-1, stays with the unconscious student, and cooperates with medical personnel when they arrive on scene. The conscious student has had to make a call related to the policy before.
Both students will receive amnesty as the unconscious student has not used the policy previously and the student who called followed all three steps of the policy ( call, stay, and cooperate ); however, they will both be given educational resources. Had the caller not followed all three steps of the policy ( call, stay, and cooperate ) then neither student would have been eligible for amnesty. Had the unconscious student used the policy previously, only the caller would have received amnesty.
4) A student is walking home from a party after drinking underage. The student sees another student passed out on a bench on their way home. The conscious student calls medical personnel, stays with the student, and cooperates with emergency services when they arrive on scene.
Both students will receive amnesty as the unconscious student has not used the policy previously and the student who called followed all three steps of the policy ( call, stay, and cooperate ); however, they will both be given educational resources. Even if the caller had used the policy before, they will still receive amnesty. If the unconscious student had used the policy before then that student would no longer be eligible for amnesty.
Had the conscious student saw the student and kept walking and was shortly picked up by the local police for underage intoxication and then reported the passed out student, neither student would be eligible since the three step policy was not followed at the time the student was found unconscious.
